Bradley Beach Elementary School has always taken seriously the issue of student misconduct and specifically harassment, intimidation, and bullying. As a school community we will continue to address these issues in both a proactive and reactive manner so that we can provide a safe and civil learning environment of all students.
DEFINITION OF HARASSMENT, INTIMIDATION AND BULLYING : Harassment, intimidation or bullying means any gesture, any written, verbal or physical act, or any electronic communication, whether it be a single incident or a series of incidents, that is reasonably perceived as being motivated either by any actual or perceived characteristic, such as race, color, religion, ancestry, national origin, gender, sexual orientation, gender identity and expression, or a mental, physical or sensory disability, or by any other distinguishing characteristic, that takes place on school property, at any school-sponsored function, on a school bus, or off school grounds that substantially disrupts or interferes with the orderly operation of the school or the rights of other students and that:
- a reasonable person should know, under the circumstances, that the act(s) will have the effect of physically or emotionally harming a student or damaging the student's property, or placing a student in reasonable fear of physical or emotional harm to his person or damage to his property;
- has the effect of insulting or demeaning any student or group of students; or
- creates a hostile educational environment for the student;
- by interfering with a student’s education or by severely or pervasively causing physical or emotional harm to the student.
Reporting/Grievance Procedures
Complaints alleging violations of the Harassment, Intimidation and Bullying policy shall be reported to the superintendent or the superintendent’s designee through use of the HIB reporting forms available below and delivered to Mr. Michael Heidelberg, Superintendent, at 515 Brinley Avenue., Bradley Beach, NJ 07720, mheidelberg@bbesnj.org or by calling 732-775-4413. The individual reporting an act of HIB has the option to remain anonymous, but the policy prohibits formal disciplinary action based solely on an anonymous report.
Prior to initiating an investigation regarding a reported incident or complaint, the Principal, in consultation with the anti-bullying specialist, shall make a preliminary determination as to whether a reported incident or complaint, assuming all facts are presented as true, is a report within the scope of N.J.S.A. 18A:37-14. If the preliminary determination is withing the scope of the definition of harassment, intimidation or bullying, then an investigation of the incident will be started.
School employees, students, or volunteers who have witnessed, or have reliable information that a student has been subject to harassment, intimidation or bullying shall report the incident to the superintendent or the superintendent’s designee. All other members of the school community, including parents, and visitors, are encouraged to report any act that may be a violation of this policy.
